Article 1 – Definitions
In these general terms and conditions, the following definitions apply:

Cooling-off period: The period within which the consumer can exercise the right of withdrawal.

Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance contract with the trader.

Day: Calendar day.

Ongoing transaction: A distance contract relating to a series of products and/or services, where the obligation to deliver and/or purchase is spread over time.

Durable medium: Any tool that allows the consumer or trader to store information directed personally to them in a way that enables future consultation and unaltered reproduction.

Right of withdrawal: The consumer's right to cancel the distance contract during the cooling-off period.

Trader: A natural or legal person who offers products and/or services to consumers at a distance.

Distance contract: An agreement concluded within the framework of a system for selling goods and/or services remotely, whereby only distance communication methods are used up to and including the conclusion of the contract.

Distance communication technology: Tools that can be used to conclude a contract without the consumer and trader being in the same place at the same time.

General terms and conditions: These current general terms and conditions of the trader.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the trader and to every distance contract and order between the trader and the consumer.
Prior to the conclusion of a distance contract, the consumer will be provided with the text of these general terms and conditions. If this is not reasonably possible, the trader will indicate where the terms and conditions can be viewed and that they will be sent free of charge upon request.
If the distance contract is concluded electronically, the terms and conditions will be made available electronically in a way that the consumer can store them on a durable medium.
In the event that specific product or service conditions apply in addition to these general terms, the consumer can always rely on the most favorable provision in the case of conflicting terms.
If any provision in these terms is found to be invalid or void, the remainder of the contract shall remain in effect. The invalid provision will be replaced by a legally valid one that closely reflects the intent of the original.
Situations not covered by these terms shall be assessed in the spirit of the terms, and any ambiguities shall be interpreted accordingly.
Article 4 – The Offer
If an offer is subject to a limited period or conditions, this will be clearly stated.
Offers are non-binding; the trader reserves the right to modify them.
Product and service descriptions are complete and accurate to allow the consumer to make an informed decision. Images are truthful representations, though colors may vary slightly.
The offer contains all necessary details, such as:

Total price including taxes;

Any shipping costs;
-
How the agreement is concluded;
-
Applicable payment, delivery, and contract fulfillment terms;

Whether the right of withdrawal applies;
-
Duration of the offer and price validity;
-
Applicable communication charges (if any);
-
Availability of after-sales service and guarantees;
-
The contract's minimum duration (for ongoing agreements);
-
Optional: available sizes, colors, and materials.
Article 5 – Agreement and Payment
The contract is concluded when the consumer accepts the offer and meets the associated conditions.
When the agreement is made electronically, the trader confirms receipt of the order electronically.
The trader ensures secure electronic communication and offers secure online payment options.
The trader may conduct checks on the consumer’s ability to meet payment obligations. If warranted, the trader may reject an order or attach conditions to it.
After purchase, the trader will provide:

Contact details for complaints;

Terms for the right of withdrawal or its exclusion;

Warranty details and after-sales service;
-
Key contract information unless already provided prior to purchase;
-
Termination conditions for contracts longer than one year.
All agreements are subject to product availability.
Article 6 – Right of Withdrawal
The consumer may cancel a product purchase within 14 days of receipt without providing a reason.
During the cooling-off period, the consumer shall handle the product and packaging with care, only inspecting it as needed to assess desirability.
To exercise the right of withdrawal, the consumer must notify the trader in writing (email is accepted) within the 14-day period.
The product must then be returned within 14 days of this notification. Proof of timely return must be provided (e.g., tracking number).
If the consumer does not comply with the above timeline, the sale becomes final.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, they will bear the return shipping costs.
If payment was already made, the trader will issue a refund within 14 days, provided the returned goods have been received or sufficient proof of return has been submitted.
Article 8 – Exclusion of the Right of Withdrawal
The trader may exclude the right of withdrawal for certain products or services, only if clearly stated prior to purchase.
Exclusions may include:

Custom-made or personalized products;
-
Perishable or aging goods;
-
Sealed products where hygiene is a concern (once opened);
-
Digital downloads, software, or media once the seal is broken;
-
Services provided on a specific date, e.g., hotel bookings or leisure activities;
-
Services already performed with the consumer’s consent before the withdrawal period ends.
Article 9 – Prices
Prices remain unchanged during the validity of an offer unless affected by VAT changes.
Products linked to fluctuating market prices may be offered at variable rates (clearly indicated as such).
Price increases within 3 months of agreement are only allowed if based on legal changes. Increases after 3 months are only valid if specified in the contract, and the consumer may then cancel the contract.
All prices include VAT. Obvious errors or misprints are not binding. The trader is not obliged to fulfill orders with incorrect pricing due to such errors.
Article 10 – Conformity and Warranty
The trader guarantees that products and services conform to the agreement, meet the advertised specifications, and comply with relevant regulations.
Defective or incorrect items must be reported within 14 days of delivery and returned in original condition and packaging.
The warranty period equals the manufacturer’s warranty unless otherwise stated.
The warranty does not apply if:

The product has been altered or repaired by the consumer or third parties;

It has been used improperly or exposed to abnormal conditions;

The defect results from regulations affecting materials or product use.
Article 11 – Delivery and Execution
The trader will exercise care in fulfilling orders and delivering products to the address provided.
Orders will be processed as quickly as possible and within 30 days unless otherwise agreed. If delivery is delayed, the consumer may cancel the contract.
Article 12 – Duration, Termination, and Renewal of Contracts
Termination

The consumer may cancel an indefinite contract for regular delivery of products/services with one month’s notice.

Fixed-term contracts can be terminated at the end of the period, with one month’s notice.

The consumer may cancel at any time, using the same method as for signing up.
Renewal

Fixed-term contracts for regular deliveries may not be automatically renewed.

Exceptions exist for newspaper or magazine subscriptions, which may renew once with a maximum three-month notice period.

Trial subscriptions end automatically unless stated otherwise.

For contracts over one year, the consumer may cancel after the first year with one month’s notice, unless fairness requires otherwise.
Article 13 – Payment
Unless agreed otherwise, payments must be made within 7 business days of the cooling-off period.
In case of services, payment is due after the consumer receives confirmation.
The consumer must report payment issues promptly.
In case of late payment, the trader may charge the consumer reasonable fees, in line with legal limits.
Article 14 – Complaints Procedure
Complaints must be clearly described and submitted within 7 days of detecting an issue.
The trader will respond within 14 days. If more time is needed, the consumer will be informed of the delay and given a timeframe for a full response.
Complaints do not suspend the trader’s obligations unless stated otherwise in writing.
If the complaint is found valid, the trader will repair or replace the item at no cost.
Article 15 – Disputes
These terms and any contracts between the trader and the consumer are governed exclusively by USA law, even if the consumer resides abroad.
